How Texas Calculates Child Support

Texas uses a percentage-of-net-resources formula under Family Code Section 154.125. The paying parent (the obligor) pays a set percentage of their monthly net resources based on the number of children covered. The parent receiving support is the obligee.

Guideline Percentages by Number of Children

The guideline amounts are set by statute and apply to the obligor’s net monthly resources:

• 1 child: 20%
• 2 children: 25%
• 3 children: 30%
• 4 children: 35%
• 5 or more children: 40%

Parents with net resources below $1,000 per month are subject to reduced percentages under a separate low-income scale under Family Code Section 154.125(c).

How Net Resources Are Calculated

Net resources, defined under Family Code Section 154.062, are income from all sources minus federal income taxes, Social Security and Medicare taxes, and the cost of the child’s health and dental insurance. Effective September 1, 2025, the monthly net resources cap increased from $9,200 to $11,700, raising the maximum guideline amount accordingly.

When Courts May Deviate from the Guideline Amount

Courts can depart from guideline amounts when applying the formula would be unjust given the circumstances. Common reasons include a child’s special needs, extraordinary medical expenses, or unusually high educational costs. Knowing where deviation arguments may land requires familiarity with how Brazoria County courts have handled similar situations.

Establishing, Modifying, & Enforcing Orders in Brazoria County

Child support matters in Brazoria County are typically heard in the 300th District Court or the 461st District Court, both of which handle family law cases, including enforcement actions and paternity establishment. For unmarried parents, establishing paternity is often the necessary first step before a court can enter a support order.

Modification

An existing order can be modified when there is a material and substantial change in circumstances, such as a significant income change or a shift in custody. Alternatively, if three years have passed since the last order and the guideline amount would differ by at least 20% or $100, that alone can support a modification request under Family Code Section 156.401. We assist clients on both sides of modification proceedings.

Enforcement

When a parent falls behind on payments, Texas provides several enforcement tools: wage withholding orders, tax refund interception, driver’s license suspension, liens on property, and contempt proceedings. The Texas Attorney General’s Child Support Division administers many of these mechanisms. Timelines depend on court scheduling and agency workload, but the tools available are substantial. We help obligees pursue enforcement and work with obligors who need to address arrears before penalties escalate.
